My problem is
I am on valid L1 with company A and company B has applied for H1 for me. If my H1 gets approved
1. Can I continue to work on L1 with company A.
2. I want to go back to home country on vacation. If my H1 is approved can I go back to my home country and come back on L1?Do I need to get my L1 stamped again to enter back in US on L1? what will happen to my H1?
Please Advice.

My friend's company is India recently applied for his L1B visa. He is scheduled to go for stamping next week. But, another company has already premium-filed his H1B petition and is expected to hear back from the USCIS anytime now.
Here's the question: if he gets his L1B visa first, can he later on try and get his H1B visa and enter the country with the H1 visa? Second, if he goes for H1B stamping right after his L1B stamping, will it affect the visa officer's decision in issuing a H1 visa?
Last question: he has already spent 3 years in the US on a L1B visa. So, if he comes here on a H1B visa, will the 6-year term limit count his 3 yr. stay on L1 visa or will a new clock start when he enters on H1?
Please chime in if anyone has done this before or has any insight on this matter.

hope I will get guidance..Here is my case....
I am an Indian and I have been living in USA for about one year as a dependent of F1 visa holder.Recently I got my I-20 and now I want to change my status from F2 to F1.I have only 2 months left to start my classes.And I have some Questions regarding changing status...
1.Is 2 months period is sufficient if I file from USA?
2. what are the chances of changing status (from F2 to F1) if I file from India?
In case, my visa status does not change,will I be able to come back to USA on F2 ? will they reject my current F2 visa as well?

My labor is approved in August 2007 and I have approved I140.It is likely that my company might declare chapter 11(bankrupt).I have not yet filed my I1485 yet as dates are not current for my PD.
My question is can I port my I140 to a different company B and extend my H1 based on the approved I140 from company A.
If yes, What documents do I need from company A to get this done.There were some posts which said I cannot port without having my 485 filed and pending approval for 180 days.is this true?
Can someone provide some suggestion what would be good approach.Ofcourse I will talk to a advocate before proceeding but in order for me to request my labor and 140 from my current company, I need to prove it to them that it is possible to port 140 without 485.

Thanks for your reply. I was off for a month and a half to complete a paper for my Masters and have proof for the same...I was not able to juggle both work and studies....will USCIS consider this excuse to be at home studying without pay?
