what is the best way to do a change of address with uscis for pending applications ? I tried online changing ar-11 and for each individual case nothing seems to be getting in effect, my FP notice still gets forwarded to the old address. I also even called the uscis customer service and changed it , still no luck. any one had similar experiences ? please advise on what to do .

I have been a silent user of IV for a very long time. When the Action item came for FOIA, I was wondering why such important information is buried in several threads. Then I started looking around in the IV site and found Action Alert button in home page. I saw this button for the first time after using IV for months and months. I just jump into the forum and start reading. I believe this button is not so obvious and it doesn't grab attention.
I think Action Alert is the first thing that users should see, so that they can know what IV is doing and how they can contribute.
IV core team / pappu - Could you please consider renaming this button and moving it so that it is very obvious to all users.

Hi All - Our priority date is current since the last Bulletin. We contacted our Senator last week for our cases. They just called us back and said that our file is at National Records Center...(not National Benefit's center). They also said that usually the cases that have been approved go there. But we do not have any approval through email or online. Info pass appoinment also did not help.
Has anybody else's case got transferred to National Records Center ?

I am from the UK currently on an 18 month J1 visa in the US that expires in a couple of weeks.
I am going back to the UK and will be studying to get a degree and returning to the US for the summer on a temp J1 Visa. My goal is to get the degree and then apply for an H1B Visa to be here for up to 6 years through my employer.
My employer is supportive and would be willing to help sponsor me for a green card application. Can i start that application now and while i am waiting for it to be processed (i understand that it can take many years) still continue on the path of getting my H1 B visa? I would be considered under a employment category 3 as the job that i want is a Camp Director job and needs a bachelors degree.
Any help or advice would be greatly appreciated - i want this more than anything despite the fact that it is going to take years to achieve - i am driven! :)

Apparently there are people who file for I-485 and I140 without labor approval.
I don't know how many people did this, but I heard there are cases of this kind.
What is the validity of this information? If it is valid, what are the risks?
The person who informed me went further explaining the procedure. He said that one needs to just file and wait for further documentation request from CIS. Upon labor approval complete documentation is presented to CIS.
Experienced souls, please advise.

SEP Visa Bulletin is OUT...surprisingly EB2 INDIA 01APR2004, but it was U in the AUG...what is going on....does it mean who ever PD is prior to that date get GC...??

I need some good advice and facts...
My friend's H1-B extension is approved but the stamping (Mumbai consulate) might get denied due to a previous (dismissed) charge for driving with suspended license.
What are the options after that? Can he re-apply for the visa stamping again using the same H1-B approval petition? Can we appeal the decision since it document clearly states that the fine was paid?
Please advise.

Family based green cards take a longish amount of time 5 yrs or so and your wife cannot enter US in that period. So if you plan to live with your wife in the US in the mean time here is an idea you can consider:
Give up your green card, then come back with H1 and your wife on H4 then reapply - you might get your green cards in 3-4 months because your 140 has an older priority date.

Guys, My appeal "I290B" for a denied I140 under EB3 category was submitted on March 5th 2008 to TEXAS service center AAO.
I have 2 questions in tracking the application
1) Are all I290B's processed initially where I140 is denied and then later sent to DC office, or completely processed by TSC.
2) If the applications are sent to DC after review by TSC. how long does TSC take to review the application before forwarding to DC and how long will DC require to process the application to close the case (I know total is 14 months for EB3)

I have approved 140, but waiting for PD to be current - (Jan/03, EB3-I).
I am now a sr manager and seem to be eligible for EB1C (if company agrees).
Option 1)
- continue to stay in Europe and apply for 140 (eb1c)+CP
- while waiting for 140 approval, am i eligible for: EAD and AC21 (after 180 days)
Option 2)
-move to US on L1 visa and apply for 140 (eb1c) + 485
Option 3)
- wait for PD for eb3 application to be current
Hope the above makes sense.
Can you pls suggest the best option & approx 'how much time' it will take for option 1 & 2. (understand option 3 is unpredictable).

This is my third EAD renewal. My 485 is pending at NSC. I am in CA. All my previous EADs/APs etc were filed at NSC.
This time when my EAD renewal is filed (by my new attorney, in new company) I got receipt Number starting with MSC.
Who decides where to file MSC? What's the criteria to file at MSC? Shouldn't it be file at NSC?
Is this a mistake?

As Senate Democrats were preparing to go to the mattresses over Iraq voting procedures and as Republicans threatened to stop all activity over a judicial appointment, it's worth recalling what Senate leaders were promising at the outset of the 110th Congress.
On Jan. 4, incoming Senate Majority Leader Harry Reid (D-Nev.) declared on the floor that "last November, the voters sent us a message - Democrats and Republicans. The voters are upset with Congress and the partisan gridlock. The voters want a government that focuses on their needs. The voters want change. Together, we must deliver that change."
Minutes later, Minority Leader Mitch McConnell (R-Ky.) observed that "the challenges ahead will not be met if we do nothing to overcome the partisanship that has come to characterize this body over the past several years. A culture of partisanship over principle represents a grave threat to the Senate's best tradition as a place of constructive cooperation. It undermines the spirit and the purpose of this institution. And we must do something to reverse its course."
Six months on, the Senate has devolved into a nonstop brawl. The House, where leaders made let's-work-together promises of their own, also is a cauldron of partisanship, but at least there the rules permit a majority to rule.
But together, they've been able to pass just three pieces of significant legislation - a hike in the minimum wage, expansion of stem-cell research funding and a supplemental appropriation to fund the Iraq War. Only the first was directly signed into law. The second was vetoed by President Bush. The third was vetoed then passed.
Partisan warfare and inaction on issues from health care to immigration to energy - even lobbying and ethics reform, once the top priority for this Congress - has reduced respect for the legislative branch to its lowest level ever. Respect for the presidency is not much higher.
Who's to blame? Senate Democrats accuse Senate Republicans of "obstructionism" - systematic refusal to grant unanimous consent so that bills can be voted upon. Senate Republicans blame Reid for invoking cloture to stifle full debate and the offering of amendments.
The level of rancor is escalating now because Democrats are frustrated that Republicans are insisting on a 60-vote threshold on Iraq War amendments - as though Democrats in the past have not used the 60-vote requirement when it suited them. Republicans are threatening to create procedural chaos and allow little or no action on the floor if Democrats block a single appellate court nominee.
In January, Senators of both parties gathered in the Old Senate Chamber in what McConnell described as "a small act of bipartisanship" that he hoped would lead to a restoration of the Senate's reputation. Now, perhaps, Senators should regather there and contemplate their current level of public esteem.

I filed for EAD (new application) 30 days back along with my AOS applications. Finished my FP on the 25th day.
Normally How long it take to get EAD from Texas Service center. ??

Now a days EAD is coming pretty quick. Some one got within a week. So it depends any where between 30 to 90 days.
