Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is (doesnt mean that it is in anyway right)... and that was my point ..

Lately the members of IV have come to know that Aman Kapoor, the co-founder of IV has sold his house and spent around $64000/- towards the administrative costs of IV. This too was brought to our attention from a regular member like you and me, without which this would not have come to our knowledge at all.
So some of the members have taken an initiative to reimburse Aman and other core IV team members with the expenses they have incurred so far towards the administrative costs of IV. Note that the time they have spent and the sufferings cannot be compensated. Let us do the least by atleast compensating the money. Please do not donate directly to IV funds.

2. Join State chapters.
3. One time contributions to the 30K Omnibus fund drive.
4. Join for monthly contributions.
5. Volunteer via State chapters.
If people don't even do this, it is obvious one or more of these can be made of them.
1. They are our "friendly" visitors from ALIPAC.
2. They are incapable of helping themselves via IV efforts. Thus the word 'Cowards' fits rather well for them.
3. They are so broke that they have time to browse the website but don't have any money to contribute.

That one in Murthy's case was that the person would be in better position if i-485 is not approved because PD is not current.
Reason is that once the i-485 is approved, his H1 status is gone. Since his wife was on H4, it is automatically cancelled. Since she had not yet filed i-485 and can't file it being PD not current. she had to return to her home country.
That will result to being separated from her husband for a long time. Therefore, it is better for both of them to be in H1 and H4 at that particular instance.
I hope this is not the same case with the OP of this thread.

I would give some days to Attendees and particularly to IV core team to analyze the rally events, meetings in their entirty and come up with the conclusions mainly for 3 things. And I request everybody to funnel data to core team centrally and the same way conclusion and future action list funnelled to members.
- What we could REALLY achieve
- How loud we could be heard
- Any potential and positive impact in near future?
- Based on all of above making near future strategy
Note: One thing I want to bring everybody's attention that from November Elections will slowly be given priority by every media and so we may have to come up with careful strategy not having any conflict with election realted major events.
We look forward to guidance from Core!
- What we could REALLY achieve
- How loud we could be heard

Here my 2 cents. Whether EB3 will move forward or not if you are in EB3 you are not in a position to chose. You have only two choices either be in USA or leave. If you decide to stay there is not harm promoting for these new immigration legislations. Even though it may have slightest chance, you have nothing to loose supporting it and working for it. In case it succeeds, you will get your green card much faster than normal process.

I am already in the porting phase. My EB2 labor is in process. I just hate to see those still in EB3 hoping their day will come. They need to port their applications right away, or those with recent filings using fake experience will be ahead of them coz EB2 gets processed first with all the spill over.
And I would rather help them than someone like you who would not even disclose your info. You are a clear example of someone trying to walk the walk of the illegal aliens.

I had my H1b till Nov 16, 2010 with Company1
Company2 applied for H1b transfer and it was approved as of Nov 08, 2010 ( but we didn't get any notification about it it's approval until few weeks later)
Company1 filed for H1b extension on Nov 10, 2010
I properly resigned Company1 on Nov 30, 2010 and started working with Company2 on Dec 1, 2010
Somehow Company1 didn't terminate my H1b extension and it got approved as of Jan 18, 2011.
1) Which status am I in? What decides my status?
2) Can I continue working for Company2 without any problems? Has this new approval put my transfer in jeopardy?
3) Do I need to update Company2 about Company1's extension approval?
4) Do I need to leave the Country to do any stamping?
Please help!!
