I currently have an L1 visa, and my H-1B has been approved (with the same employer). The H-1 was applied for as an initial petition. I'm going to get the H-1 stamp on December 18th this year. I'll be coming back to the states then after January 1st.
Are there any issues with a new sponsor filing to a H-1B transfer straight away after I come back? I will have pay slips with my current company, but they will mostly be from when I was on an L-1 visa. Is this an issue with this? Or is there anything else I would need to be concerned with?

I am new to this and I sent email couple of times and called certain people in IV list.
Most of the responses from the senator/congress members or even conversation refers undocumented immigrants, safe/secure borders etc.
What is missing in representing the EB community different to illegal immigrants ?

Welcome back :)
First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

1) Yes, the positive was that the attorney was very helpful in answering the Qs in detail with several follow up questions face-to-face.
2) The members we had never met before who boldly allowed me to video tape their introductions. And committed to being more 'Active'.
3) New member brought two items for the future garage sale. Now seeing that nobody else had acted upon that request, it will probably give him an impression that the next time something is asked of members, it is not to be taken seriously, right? sorry to go into the negative again.
I wouldn't call anyone coward, it is a very strong word. No one would like to be called that. But I definitely saw a lack of commitment or 'proactive' (I dont want to sound like your manager :)) attitude.

Having an approved 140 and a 485 pending for more than six months is the safe method of switching. For AC21, the key is to have your 485 pending for more than six months. You can use AC21 to switch employers after six months of filing of 485 even if your 140 is not approved. Its not a simple process but folks have done it.

Dear Members,
We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.
Our angst, our insecurity:
Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.
Early effort wins:
The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.

You and help in two different ways:
Join the advocacy effort in DC on June 7th and 8th. First of all,based on the information you provided i believe that
1. You are continuously employed WITHOUT any gap, meaning working 40 hrs/ week and clean history of pay stubs, W2s etc
2. You have been working for only one employer at any given point of time, as a full time employee
IF What i said above is true, then RFE makes no sense. because based on the H1B rules and regulations, one can have multiple H1Bs BUT can only work for ONE employer as full time, meaning 40hrs/week.
It is also completely legal that one can work up to 20hrs/week for second employer by paying proper taxes . but in your case i believe that you have worked for only one employer and i think you can show the evidence.
Please contact your attorney and draft a response carefully
