Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. Believe it or not, many fraud desi firms have sponsored people in EB-2 successfully. I have worked with many such IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious here, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. I am just tired of fellow country men/women who have diminished our country's image, especially in the IT industry and am trying to think of solutions in addition to what we already have on IV's agenda.
Is english speaking required to qualify for EB2 ? who diminished the country image ? In our company Indians are highly regarded and yes most of us work for desi companies . Dont blame others just becasue your company dont sponsor in EB2.

Ofcourse everyone is very excited that the priority dates are current but let's take a careful look for why it became current all of a sudden even when the demand for visa numbers is so high and was backlogged by 5 years up until couple of months ago.
1. I sincerely feel this is just to keep the legal immigrants to stop protesting for benefits in the CIR. Well, the CIR is supposed to be dead right? Wrong, count 2 weeks from now and the Bill will be back with tons of benefits for Illegal aliens and none for legals.
2. Currently Service centers are processing cases received in Aug-Sept. '06 with the few thousands of applications being submitted for the next few weeks the processing dates will be moved back by couple of years. All this time we were waiting for the priority dates and now will wait for the processing dates to be advanced. What a circus!!!
3. Just when the case is ready for processing that would be atleast couple of years from now, the priority dates will be retrogressed may be by 10 years this time.
To my knoweledge we should still continue to lobby the senators and get the Visa numbers increased, get the country quota eliminated, Only one visa should be counted per family... and get it into the CIR. Should the CIR pass without these ammendments legal immigrants will be stuck in limbo for every because there will be no more CIRs in the near future.

Without administrative and legislative changes, the answer to number one is "a very long time" and I think I'd be safe to say that is a conservative estimate. For the record, I'm also EB3 ROW, with a PD of early 2004. I would say that would be current in 3 or 4 years
There are roughly 200 countries in the world. It is very simple maths to figure out that 200 * 9800 (the 7% limit per country) = about 1,960,000. Its pretty obvious that this is much more than the limit of 140,000 total per annum.. and you begin to see why there is a problem. Sure - each country has a 7% theroetical limit, but not EVERY country will use that in a year. Of ROW countries, UK is pretty close to its 7% per year. Others, like Lichenstein are not (or they would all be in the US and the country would not be just one big vacation home)

They are quite regret that they did not come back to China back 5 years.
So what I want say is that, US is not a very good place to stay anymore. There are many golden opportunities in your own country! Many countries are becoming stronger and stronger. It's not 10 or 20 years ago. 10 or 20 years ago, US is the best place in the world to stay. But now, it's different. My friends in US make about $150k a year and cannot afford a luxury lifestyle. I make $100k a year and enjoy a very comfortable life in China. I built my own house in China, which is even better than my house in New Jersey before. I hired my own chauffeur, housekeeper, two nannies for my baby... I cannot afford these thing if I were still in US. How many americans can afford the same lifestyle as mine? I don't think there are many.
My point is, be open to opportunities in your own countries or other countries in the world other than US. You will be happy to leave US several years later when you look back. Besides, if more and more US-trained scientists and professionals come back to their own countries and help their countries to develop, maybe in another 10 or 20 years, no one would want GC anymore."

With a due respect, I am differ with your statement on Competeamerica. Competeamerica has always promoted H1B and EB provision together. I haven't seen any time that they promoted only H1B.
I spoke with one guy at Competeamerica and he told me that IV is neutral on H1B issue eventhough all members have came through that root. Personally I am very positive with Competeamerica and it is not good for us to speak negative for this organization.
As the saying goes �the proof is in the pudding" anybody can give statements but it is the results that matter. What results has compete america achieved, they are just giving lip service. Contrast them with the health industry lobby which has achieved results year after year. Compete america ultimate goal is more h1b which they will achieve one way or the other.
Don�t get me wrong, I am not saying compete america is bad, I am just saying there focus is on H1b and not as much on EB relief. If they face a hypothetical situation where they can get either H1 or EB, they would gladly choose h1, that�s the bottom line. Its better to have somebody like compete america rather than nobody, but we need a corporate lobby whose main focus is eb relief.
And there is an important lesson to be learned from the health industry lobby. They just did not say they want CIR or skil and then went back when both cir and skil failed. They started chipping away at individual items like 50000 visas for Schedule A last year and 90000 this year from unused\recaptured visas. We should also be asking for our individual line item, 485 measure. This is how a war is won, one battle at a time. It is unrealistic to have an "all or nothing" attitude that people opposing 485 measure have. If the health industry lobby had such "all or nothing" attitude they would not have got the 50000 visas last year nor would they have been trying to get the 90000 this year. Hope we learn from them.

2. He is not going to do anything for anyone in his last few months. Especially for us who are not in anybody's radar.
3. The white house is better staffed to handle mail and has a larger team to scrutinize mails. Truth is Bush meay never hear about 25K mails sent over a month.

4. We cannot be just an internet forum anymore we need meet n greets..periodic meetings that bring ppl together face to face.

What is fair is that we treat everyone here (and everywhere else for that matter) with respect without regard to the country of birth or the EB category. Some are more educated than others, some are more skilled than others, and some are more lucky than others when it comes to green card but what is common to everyone of us is that we are in this mess together. To be honest I don't think we are here to figure out what's best for United States, we are here to get our green card, live the American dream, and make the best out of it.
Therefore, let's not make this GC journey anymore difficult than it already is by fighting amongst ourselves about who is more skilled and who is more deserving. Besides, constant bickering among the IV members will only further divide and alienate more members and won't help us in any way so I suggest that we avoid doing things that has the potential of dividing or alienating members.
Apart from the bad language used by some people .... I dont believe that there is any infighting .... disagreements with point of view is not infighting ... It just a primer for the points and discussions that will definitely come up when lawmakers will argue their points of view. And from that perspective it is enriching this portal forum and not denigrating it.
I welcome the discussion.

My friend has a similar situation.
He transferred H1 to Company B and worked for 5 weeks and descided to come back to company A (He is 100% sure that Company A didn't revoke / calcel his H1 and he has valid H1 till 2009).
IS this OK?

Now that CIR is defeated again for nth time, We really need to consider rethinking about our stratergy,
I guess we are about 15K membership and if we include spouse and take a guess every one in five has dependent kid to join (wild gusstimate) we come close 35-40K approximately.

to recapture visa numbers we don't need any legislative reform AC-21 does apply,
We need to spend more energy in researching possibility of recapturing 90K visas and we will be done,

A total of 2.5M cases pending (AOS and naturalization), only 1.2M are ready for action.
For true backlog numbers look here, Ombudsman report, Page 14.

1.3M backlogged cases TOTAL (includes naturalization), out of which more than 800K are retrogresed family-based AOS petitions, and what looks like 30K EB petitions (cannot be approved due to statutory limits). 300K cases in namecheck, maybe 10% of them are EB (EB is about 13% of green cards), so we are having about 60K truly backloged EB cases in March 2007.
We know that cases that are current and not stuck in FBI checks are being approved farily fast, so my gut feeling is they have maybe 50-80K EB cases in active adjudication. Let's double-check -- out of 1.2 million cases ready for action, about a half is naturalization, and from the other half, ~13% would be EB - yep, 80K (EBs are the easiest to approve because there are no interviews or tests, so the percentage is likely less than 13%).
So, in March 2007 there were a total of no more than 140K pending cases in I-485 stage of stocessing. Now in June-August EVERYONE who had an approved LC got to apply, and there were ~300K applications, while CIS gave out ~70K green cards, so we would have a total of 370K pending petitions. This estimate is surprisingly close to 13% of the total 2.5M backlog, so I would consider it good.
Again, I absolutely do not believe there are more than 500K EB1-EB3 cases. There may be another 500K in the 'other worker' category, but this is not what we are talking about here.
We can argue who is right on the numbers for a long time, The Ombudsman, who quote that they can not say for sure what the numbers are, or the kauffman Report who claim 1.1 million. Even if we go with your number of "no more than 500K" - thats a 3 year wait if there are no more country caps.
Also from the Ombudsman:-
"In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards." - Pending applications for employment-based green cards means "application approved pending visa number availability" - ie all but approved - waiting for a visa number, not all 485 applications.
"As of May 2007, USCIS reported a staggering 329,160 FBI name check cases pending"
I'm obviously not adding those numbers together, but I really believe that the numbers are larger than we think.
Remember to take out the visa's unsued each year (per the ombudsman, in the last 3 years, thats only 100k wasted) that brings down the number of visas available, and remember there are other visa paths into greencard application, not just H1B.
They also think there are roughly about 170K at BEC... that haven't hit yet. Add that to the number - all with old PD so you better believe their dates will come current sooner.
If you've read the Ombudsman's report, you should have figured out that things are NOT moving quickly

Finally - if you've read the Ombudsman report from the past few years, they will look very similar to this years' one (although they gradually get more and more bleak). Nothing has change to make the situation better, so the expectation that all of a sudden things will get fast now still baffles me.

We know that cases that are current and not stuck in FBI checks are being approved farily fast, so my gut feeling is they have maybe 50-80K EB cases in active adjudication. Let's double-check -- out of 1.2 million cases ready for action, about a half is naturalization, and from the other half, ~13% would be EB - yep, 80K (EBs are the easiest to approve because there are no interviews or tests, so the percentage is likely less than 13%).
