dear hydboy77, after reading your posts, I agree with another member -- that you have totally different goals and concerns from the pre-application of AOS. It would be the best to start a new thread for your concerns, and leave this thread soles for AOS pre-application.
Getting rid of semilar\same job requirement is going to be as easy or as difficult as getting prefiling AOS.
Getting rid of same\semilar job is not semilar to getting to green card. If you are a software person then you can put a restriction that you have to work in a software related job, in the same way if you a civil engineer then you should work in the civil engineering field. But the way USCIS does same\semilar job is job code match, responsibilities match etc etc etc, the problem with this is it is a very grey area, it is almost like doing labor all over again. It has not become that bad yet but it will sooner or later, how many H1b rfe\denials did you know in the last 2 years, I bet there are more H1 denials in the last 2 months than the whole of last 4 years.
I understand you are not being selfish but why would anybody want to use EAD instead of H1 other than for getting rid of visa stamping purposes. The overwhelming majority of people are going to use EAD to switch jobs because of layoff . When people are transfering H1b because of layoffs they are getting rfe\denial notices, when you move from H1b to EAD because of layoff USCIS might hit you with the same\semilar job rfe (when you file ac21, when previous employer revokes H1 or I140), that is my point.

I've read the document. IEEE is supporting "Immigration Visas" but not H-1B visas(temporary).
Can you shed some light what they meant by "Immigration Visas"?
It would be great if you can give us an example of some one coming on "Immigration Visa" and becoming a permanent resident and subsequently a US citizen.
Immigration visas are really GCs themselves. The only ones that I know who come directly to US on one are the family sponsored immigrants.

There is a site called http://www.hvisasurvey.org which conducts surveys about the lives of poeple on different H Visas. They were lobbying for H4 work authorization and protection under VAWA for non-immigrant woman.
I have a suggestion. Why not ImmigrationVoice Join with HVisaSurvey and Lobby for more rights for H4 Visa Holders.
At least the H4 should be allowed to work if the labor certification is pending or the I-140 is approved for the H1 visa holder. Waiting for I-485 to become current is a long wait. Why nobody care about H4s. L2's got work permit because the big multinational companies who used a lot of L1 visas lobbied for it.

This mess was not created by the guy with a PD of 2007 but by USCIS. So, you can hate USCIS all you want but what did the guy with PD2007 do. He just got lucky. He got lucky, plain and simple. Why should anybody feel bad about someone else's luck?

I know you have done a lot for IV.. no body needs to vouch that.. i have seen you in action..but.. i disagree with you on only one thing, calling names.. I understand your frustration, but as a leader you cannot set a bad example... No leader has ever got people to do the right things by calling them names.. while your intent is right, you have done more harm than good by starting this flame war..

I have said what I have felt. I am not going to be politically correct, never have been. This is not a forum for pracitising genteel speeches, pampering and politically correct messages.
If you RSVP that "I will come" and the host prepares entire day for meeting, makes her daughter skip the extra carricular activities, ends up using better part of weekend for an event she is thinking will be attended by you, but you dont show up even and dont even bother to call they you are cancelling, then you ought to be ashamed of yourself. If you do something like that in your workplace, then you will get fired. If you signup for a volunteer training/conference on behalf of your company, get company to book your travel, make them spend time/money and then on day of travel, you dont even show up at the airport and attend conference/training that you volunteered to attend, then you will get fired. You wont get fired from Immigration Voice and there are no personal consequence to your bad, lousy manners therefore its afforable to do so, and so you can do it.
If you think EAD is the end of the road and you are free now with AC21 options BUT on the contrary you feel more and more need to visit forums here, on Khanna portal, on Murthy's forums/chats then probably you are wrong, you are not free. You are still bound by strings that restrain your mobility and freedom.
LURKERS : And finally, if the only reason (and this is the most common reason) for not volunteering or participating in activities or contributions is that you are afraid of USCIS or some agency retaliating against your pending 485, and the problem is cowardice. Your concern is 100% justified, but BEC has vowed to clear all backlog by Sep '07.
When the dates move forward in Oct '07, you will have advantage with your PD.

Anyone else having problem or I am the only one?
I worked with Fragomen for my GC and H-1B application. I didn't had any complaints/issues with them. They followed up with me (twice) for renewing EAD & AP, but I went ahead and did it on my own. One thing I've observed though with Fragomen is their administrative office makes a number of mistakes sometimes. Like for me, I got invoices in error a number of times which when I worked with my attorney were taken care of. Also, on their client portal I noticed my receipt numbers were erroneously entered, which when I reported to them were corrected. I guess that could happen in any law firm. Overall my experience was good!

though most part of Sch-A is doctors and Nurses it also covers under its Categorey II EXCEPTIONAL ABILITY PROFESSIONALS in ARTS AND SCIENCES. So some of the PhDs, Scientists and academics are also covered under Sch-A.
I think to oppose Sch-A s effort or H-1 B is counter productive to the IV's goal as both of these categorey include wide ranging support from Health as well as Tech Industry. More over Labor Department have already accepted by giving BALANKET APPROVAL TO SCH-A that THEY ARE THE SHORTAGE OCCUPATIONS. so there is established precedent for that.
We should focus more on PACE, SKILL or OTHER education or energy bills and try to accomodate over concerns and points in those rather than focusing on CIR, which is most likely to be in discussions only till PRESIDENT for 2009 take over his tenure. No body wants to touch it, they just want to get hispanic votes so will tell that they want to do this but will not do it as it takes away several moderate conservative votes.

If 32k calculation is correct (which looks like - yes), then EB2 is not just fixed for time being, it will be fixed for ever. In turn, it will help all our EB friends going forward.
Based on your calculation its 27849 additional visas + 1/3 of 9,800 (=3,266) = 31115 for EB2 India for 2008 fiscal year and the coming years ahead.
So this is almost 10 times more visas fo EB2 India. So EB2 is going to be fixed for the time being.

For me it's simple. My test case is HR5882. I have seen that Democrats fully supported the bill while Republicans are trying to stall it.
I can predict that Democrat will help us. It was during the time of Clinton when immigration into the US was easy. Visa Bulletin was almost always current. AC21 was passed during the time of Clinton, a democrat.
So, tell me. What Republican bill was passed that supports legal immigrants?

I have applied AP two times so far. I have always got my AP started date is same as expired date of previous one so in a nut shell, I dint loose a single day. I have always sent a cover letter explaining the different dates so that might have been the key.

In fact a fellow indian wearing a turban tried to get into the consulate just before the consulate officially opens. The person inside (not the security) threatened him that he/she will call security and through him out!. Thats their attitude... They (at least think) belong to ruling class of india, so they behave like that?!

Yes. You need to write name and A# behind the photos with a soft tipped pencil as per USCIS instructions.

so far....they rushed my application last year in July 2007 so I didn't miss the bus. I guess it depends who you are working with. I worked with Maria V. who was good.
