I would love to attend the rally. However my financial condition at this time does not permit me. I could have booked a ticket on my credit card but all my cards are max out!
You want to know why I am in this financial deep hole? Well, I have two sons in college and paying out of state tuition, that is over $17,000 per semester for both of them.
My wife on H4 could not work until now that she has an EAD. It is retrogression that I should blame and I would love to do all in my power to obtain relief or bring the issue to the attention of the American public.
In my own way I have contributed to IV both in cash and in kind. I have told me story in countless media interviews. I only wish I could do more for IV financially but alas I am not able to do that at this time.
I would be in the rally in spirit....only I wish I could attend in person.

I know you have done a lot for IV.. no body needs to vouch that.. i have seen you in action..but.. i disagree with you on only one thing, calling names.. I understand your frustration, but as a leader you cannot set a bad example... No leader has ever got people to do the right things by calling them names.. while your intent is right, you have done more harm than good by starting this flame war..
I guess the right thing to do for the texas chapter is to call the members and find out what happened. We have chapter members phone number right?

I have said what I have felt. I am not going to be politically correct, never have been. This is not a forum for pracitising genteel speeches, pampering and politically correct messages.
If you RSVP that "I will come" and the host prepares entire day for meeting, makes her daughter skip the extra carricular activities, ends up using better part of weekend for an event she is thinking will be attended by you, but you dont show up even and dont even bother to call they you are cancelling, then you ought to be ashamed of yourself. If you do something like that in your workplace, then you will get fired. If you signup for a volunteer training/conference on behalf of your company, get company to book your travel, make them spend time/money and then on day of travel, you dont even show up at the airport and attend conference/training that you volunteered to attend, then you will get fired. You wont get fired from Immigration Voice and there are no personal consequence to your bad, lousy manners therefore its afforable to do so, and so you can do it.
If you think EAD is the end of the road and you are free now with AC21 options BUT on the contrary you feel more and more need to visit forums here, on Khanna portal, on Murthy's forums/chats then probably you are wrong, you are not free. You are still bound by strings that restrain your mobility and freedom.
LURKERS : And finally, if the only reason (and this is the most common reason) for not volunteering or participating in activities or contributions is that you are afraid of USCIS or some agency retaliating against your pending 485, and the problem is cowardice. Look at the unity in our diversity...for a moment while reading some of the comments I forgot I was in the US and looking at an supposedly elite forum...Bravo!! Keep it up Indians (Tamilians, Gujaratis, Marathis, Bengalis, Biharis, etc..)
One more thing, if you are upset with a person who misbehaved with you (in this case, rudely told you he didn't know any language other than Hindi), then logic tells me I should be upset with that person and not the reason (in this case, language) itself.
I belong to a Hindi speaking part of India, and I have lived in Pune, Bangalore, and Hyderabad. I've had people tell me very rudely to talk in the native languages of these areas and I've tried, sometimes successfully and sometimes, not so much. The rudeness of a few members of the community never led me to form a general opinion. I've very close friends from all over India.
It is my opinion that one should try to learn the local language. It bodes well for everybody and makes life easier. As matured people that we are, I think this is a very trivial issue to fight among ourselves or get emotional.

Hi,
I came in Jan 07 on F1. I got my H1-B in Apr 07, but is effective Oct 1, 07. My school, NJIT, starts on Sept 1, 07. If I have to maintain a full-time student status from Sept 1 to Sept 30 then I have to pay $5,000. If I have to maintain a full-time student status from Sept 1 to Sept 17 then I have to pay $1,200.
Please let me know
1> Will it be problem if I don't take any course in Sept i.e. I am not a full time student during Sept.?
2> If it is problem then will it be problem if I drop courses on Sept. 17? What will be my status for 13 days from Sept 18 to Sept 30?
3> Is there any college in NJ/NY area which starts in Oct so that I can transfer to that college and maintain my full time status till Sept 30?
4> Any other suggestions about what I can do?
My employer has suggested not to go to India and go through H1-B stamping.

It can be shown that per country quota leads to (unintended) discrimation at employment and hence the GC per country quota is illegal.
Employment based GC per country quota => A very long wait (eg. more than 3 years) in same or similar job position for people born in only few countries => Hinderance to career growth because one cannot advance from engineer to managerial position even though he/she is qualified for the promotions while his colleagues from other countries can => Person from an oversubscribed countries such as India does not have equal opportunity to career advancement because of a very long wait time difference between people born in these 2 or 3 countries and people from all of the other countries.
Key Point: Equal opportunity employement advancement is protected by "Title VII of the Civil Rights Act of 1964 (Title VII)" and hence the Supreme Court can overturn the per country quota limitation if the Supreme Court finds that the per country quota leads to discrimination at employment.
National Origin Discrimination & Work Situations:

When it is already proved that no American is available for the skill set required and being substituted with a Foreign worker, then from where the nationality came in to the picture?

The U.S. has a policy of cultural integration called "the melting pot". The idea, is that instead of (as Canada does it) maintaining simultaneous separate cultural identities (referred to as a "mosaic") cultural identities are "blended" together to arrive at a new cultural identity that will still be uniquely "American".
Given this policy, the per country quota makes sense, since to not restrict immigration from certain cultures risks the potential of getting more of a mosaic than a melting pot (since if there is sufficient "critical mass" of one cultural identity, this group would be prone to establish a "district" of their own and maintain their source culture). An example of this is the "little country" syndrome (e.g. little China, little Vietnam, little India, little Italy, etc.).
Does the companies bother about the skill set required or the nationality?

Applicants from countries that don't achieve quota are subject to the exact same tests on their qualifications as applicants from countries that do achieve quota.
I think what frustrates most people here is not the per country quota, so much as the low level of the overall quota (since, as others have pointed out, most countries do not use their quota, and that quota *is* redistributed to the countries that do achieve quota, thus allowing them to exceed quota).
So in effect, all the per country quota does, is give applicants from those countries first-crack at available visas *once other countries are at quota*, and has no effect at all until some country has hit their quota.
I think there is plenty of room for discussion about what percentage a country should be able to send, and what the overall number of visas should be, but I really don't think the per country quota is worth getting worked up about.

My wife moved from H4 to H1 in June 2007 and obtained her SSN at the same time. We used her new SSN to file our returns in March this year. However, no sign of the stimulus package yet. Wonder how is our case being considered. Thoughts?

This is a good first step in this direction after our campaign for FOIA last year. If we can get the data we need, prediction on date movement and getting the clear picture on pending applications should be easy.
I personally feel 5K is too much to charge, but if this is what it takes I think we should pursue it. Lobbying for it may have cost more. We need to get more information about this and if everyone agrees we can raise funds and pay for one request to take it forward.

Option 4- Stay in H1-B status for 9+ years and you will become a religious person automatically.. after 9 years you will reach a level where no country, no citizenship, no relationship would matter....only MURTHY JI would matter.
It is my own experience.
You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
1. Get a Ph.D, get a job in a univ and apply in EB-1.
2. Get a MBA and get a management job and apply in EB-1.
3. Become a religious worker in some temple and apply in the religious worker category.

People with 07 PD has the privilege to cheer when they cut in front of us, but we should not feel sad for being pushed back because it is a disruptive behavior.

Just because ppl are able to file 485 does not mean that they are going to take a number out of the quota for that year. The numbers are only taken during approval and hence they would all still be stuck in the same queue and you would have gotten an oppurtunity to file and possible get your GC too...take a deep breath, relax and think about this with a cool mind. I definitely do feel bad for you. My labor was stuck in BEC too and i left my company and joined a new one and restarted all over again. Been on H1 for seven years without ever getting any chance to file 485 until now...
