I went to SSA office today and they did not accept the application. I had all the necessary paperwork such as SSA guidenace on Non-Work Purpose SSN, Letter from IRS (one that every taxpayer got informing about Economic Stumulus Package) and FAQ regarding Basic Eligibility and ITIN for Economic Stimulus Pakcage from IRS website.
They simply refused to accept the application. This is unacceptable as I do not think lawmakers envisaged such a situation when they announced plans for Economic Stimulus Package.
Of course it is unacceptable. They cannot refuse to accept an application. How can they review your case if they wont accept your application. That is a violation of your rights. The only reason they refused your application is that you are an immigrant. You can therefore file a discrimination complaint against them using the form I attached in my earlier post. Also, contact your congressman and/or senator. They usually have a constituency services department that handles cases like these. If you want to PM me, I can help you with the specifics.

I think that going back to your home country ONLY because you feel overwhelmed by the delays in GC processing/retrogerssion (assuming you are quite content in your job and standard of living) is not a good idea. Especially true in the event that you and your family experience difficulties in adjusting professionally and socially after returning back. Chances are you might soon get a feeling of having taken a wrong decision in the heat of the moment, especially if the guys who stay back and ride this retrogression storm see some relief while you are still trying to adjust to the changed environment of your home country. You may even get tempted to come back and give the GC thing another shot but then you have to start at square one again.
Going back to home country only because of the shortcomings of GC process is like deciding to take a sanyas because you are tired of dealing with social issues. A true jogi is one who understands the triviality of society and decides to rise above it...not the one who denouces it because he can't deal with it.

at least can we not take any legal action for issuing out a rule (you can file MFS and get the stimuls and then amend MFJ) on 04/14/2008??? what about people who filed a long time ago as MFJ?? Because once you filed MFJ, the action is irrevocable!?! In my honest opinion, this stupidity of issuing out a clause the day before filing deadline deserves some "stir"!!

Based on last week's BusinessWeek article, I have a feeling that we will see an effort to restrict initial H1B applications in some way. That would be a good opportunity to push for allowing naturalization applications for people who have been on work visas for a long time (say 8-10 yrs?). Fighting for citizenship would have a stronger emotional dimension and may connect better with the American public. A direct filing for citizenship will work around retrogression by providing an avenue for people to move out of the GC queue.

I entered US on H4. Then applied for H1 for software job. worked for 2 months last yr and then went for maternity leave.
Now I started working again and I still have to go for stamping.
I have completed CPA and I would like to move to an accounting firm ( they have to file my H1 transfer with accounting domain).
Is this going to cause any problem during H1 transfer or stamping??

So based on what you mentioned below :
Persons who sent their apps, now if they become curent in Oct, they will process those applications. And all others appls will be returned by Oct/Nov 2007 ?
Seems like folks have to wait in dark for 3 months ? are u sure about this ? or is it hearsay ?
I have always been of the opinioin, that the most correct thing for the USCIS to do at this point is to not return the applications, but hold them until Oct. When the window technically re-opens, just swallow everything that is on hold - the window technically only needs to open for a few seconds for that to happen.
The other thing they should also do is accept all 485 applications till the end of July and process them likewise.
Giving everyone EAD/AP benefits does not hurt....they can then line up all the 500-700K people and issue the green cards as per visa number/PD/RD availability...

I didnt get rebate check this year because i havent filed my wife and kid EAD.
I can apply for their EAD and get SSN so i can get the rebate next year but that costs money too.

Do you have any thoughts on how many people could be in this category wage level II in EB-2 I?

I know this is probably asking for trouble but no movement can be credible without listening to the dissenting voices. So here is my gripe ... You cannot open a single thread or forum without being asked for contributions these days. People are told that if they dont contribute, they are not "supporting the cause".
And this new caste system of the DONOR forum which basically says screw you to everyone who has spent time, money or effort on IV and completely goes against the "Change for fairness and Justice" mumbo jumbo is a step in the right direction, IV needs to give way to an actual movement that actually does something and this DONOR forum concept will certainly go a long way in the marginalization of this site and community.
Can I safely assume that you are another anti-immigrant wearing an immigrant's garb and whose sole intention is to argue back and forth with folks who believe in IV so that their energies are drained arguing with you and that they have no energy left to contribute to the common cause of the highly skilled community who by the way has no other voice out there besides IV?

I am real optimistic that introduction of a separate bill (SKIL)will definitely make its way through. Passage of CIR is primarily restricted because of illegal issues. I hope the house and senate look at the passage of SKIL Bill as a critical step (even if some don't like it).
Wait until they start getting to the details before being optimistic.
By the way, how long does it take for a bill to get debated and voted on from the time it is introduced? Months? Years??
