Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

Some EB3s might have expressed jealousy .Shame on them. But most are expressing anger because EB3 is "U" and the spillover formula will keep them retrogressed for years to come and not because EB2 moved ahead . Godd for Eb2s.
Your India specific jealousy example can be applied of any country. India does not hold monopoly over jealous acts. People are jealous not countries.

That is right. But same country quota is there in EB system also. So in point system also 80% of people will get same quality of people as current system. But advantage is process delay will be eliminated.
Right now, in the EB based system, the employer picks the applicant, not the Federal Government. Also, under the current system, even if the country is limited by quota, it is a soft quota. No matter how you see it, the current system attracts the best and brightest and rewards only only those who are physically in this country with the GC (EB based). how can that be compared to the merit based system which you claim would attract the 80%? Any tom/dick or harry can apply from any country and get thru.

Too late in the game. Lets just finish up what we've started. I believe in go green (I pledged not to buy another box of ziplocs) , but if 25000 sheets of paper will bring me my fixes, I don't mind planting 20 trees to make up for it.

One change I noticed.
Now people can continue in the old system if the I-140 was approved or pending before the first day of the fiscal year subsequent to the the bill being enacted. So if the bill is passed right away, you need to have filed your I-140 before Oct 1 2007.

I have a few questions regarding the application for AP for a dependent, and I would appreciate it if someone would answer them.
1. If the dependent is applying for AP, should I include the primary applicant's I-485 in the application packet?

I am on L1 Visa & I went to SSN office to apply SSN for my child (L-2 Visa). They refused to accept my application and they wanted Documentation from the appropriate government entity explaining the need for the SSN as per

Get support from whom? The same corporations that want to outsource jobs to low cost countries AND also lobby for H1B increase, again to keep wages low and all this to increase their bottom line. We need to re think our strategy and get it straight as to who is on our side and who is not.

I don�t like CIR from the beginning because it is a compromise of four parts which are illegal, high skilled, family based, and border tightening. Obviously we are the smallest group in CIR so our interests were barely considered but we were sacrificed whenever they needed to compromise. So I believe we will live after CIR is dead! Why so sure? It is because the provisions for EB and H1 have to be considered in some way. It was a joke to the lawmakers that the H1 cap was reached in the first several hours. Some lawmaker criticized the abuse of the quota. But it also reflected the fact that there was the shortage of the quota because the shortage invoked a strong desire which led to abuse of the quota.

The enactment of this new law is yet another sign that the federal government needs to act to fix our broken immigration system rather than allowing for a state-by-state patchwork of laws and ordinances. I also believe Arizona's law raises civil rights concerns, fails to recognize the economic contributions of legal immigrant workers, and harms our nation's ability to attract entrepreneurs from around the world who create jobs here in the United States.
Our nation faces many tough challenges. Immigration reform is a complicated and difficult issue but the current system is not working. We must put our differences aside to create a better system. One way is to invest regularly in 401 K. By that way you let your investments grow tax free and if you have to or go back to India then you can withdraw them next year, TAX free or less tax. Thus you actually pay less tax and ultimately you might pay lesser tax than your social security. Who cares if the social security is being taken from me.

Get copies of your 140 approval and labor filing papers. Look for a job and transfer h1b , you will get 3 years transfer/extension based on yiour approved 140.
Once you settle down in your new job, apply for new Labor in PERM (preferably EB2) , and you can port your earlier priority date.

If Senators are not willing to indefinitely extend AC-21 clause due to fears of skewed country-wise immigration numbers then it can be argued that at least to relieve the current backlog the AC-21 can be put for a limited time period ( 5 years or so). this may be a workable compromise if the other goal is difficult to achieve.
